An "adverse party" upon whom a notice of appeal must be served, is one whose rights may be injuriously affected by reversal and modification of the judgment from which the appeal is taken. 2. Appeal and error ? Effect of failure to serve notice of appeal. Where one of two defendants appealed from a decree holding that plaintiff and another defendant owned property as tenants in common and declaring that the deed thereto executed by the acting commissioner of state lands to the appealing defendant was a mortgage, defendant who was held to be a tenant in common was an "adverse party" upon whom notice of appeal was required to be served, notwithstanding that he had disclaimed any interest in the property in himself except an expectant interest in case appealing defendant prevailed in her claim.
